The Real Estate Division is responsible for receiving, recording, processing, indexing, and maintaining a copy of all documents related to real estate within Henry County. Uniform Commercial Code (UCC) is also filed here and serves public notice that personal properties (equipment, furnishing, vehicles, crops, etc.) have outstanding liens against them.

This office also handles Notary Public Commissions, Trade Name Registrations and DD214s.

  • $2 per cross indexing of each instrument
  • $2 for each additional page

Locating Records

You may search for deeds and liens online here and you may search real estate property records here.

To locate real estate records, it is time saving to have the following information prior to coming to our office:

  1. Buyer's Name (grantee)
  2. Seller's Name (grantor)
  3. Date of the transaction

This information is necessary to search the real estate indices to find a book and page number.

Misc. Records

To locate records on the General Execution Docket, Trade Names, Charters, Limited Partnerships, General Partnerships, or Notary Public appointments, it is time saving to have the following information before coming to our office:

  1. General Execution Docket - name of plaintiff or defendant and the date ofjudgment
  2. Trade Names - name of the business
  3. Charters - name of the corporation
  4. Limited/General Partnerships - name of the corporation
  5. Notary Public - name of the notary and date of commission

Should you have trouble locating or copying records, any employee in the Clerk's Office are available to assist you.

This office cannot research information about recorded documents by telephone. The information maintained is public record, and anyone may come in to research documents. Deputy clerks are available to assist Monday - Friday, 8:00 a.m. - 5:00 p.m. To research documents online, please click here.

Notary Public

Becoming a Notary Public and applicable laws are available through the Georgia Superior Court Clerks' Cooperative Authority (GSCCCA).

Renewal Applications must be processed PRIOR TO EXPIRATION of an existing, active Henry County notary commission. A commission can be renewed no earlier than 30 days prior to expiration.

Effective January 1, 2020- Notary Fees have Changed:

Notary Application Fees

  • New Commission: $51.00
  • Renewal Commission, in office: $51.00
  • Renewal Commission, by mail (must pay by credit card)

New & Renewal Application Instructions

  • You must apply in the county in which you reside.  When applying for a New Notary Commission, the character witnesses must also be residents of Henry County and they must sign the application.
  • Please go to www.gsccca.org/projects/npapp.asp to complete an application.  Completed applications should be brought to this office for processing within 30 days of the online entry.  Applications not processed within 30 days will be deleted from the online system.
  • Please bring in a valid driver's license.  Make sure that the address on the application matches the address on your license.  Should the addresses not match, you must provide a utility bill showing your name and current address. Between the hours of 8:00 a.m. and 4;15 p.m. Monday through Friday.
  • The Clerks' Authority (GSCCCA) is offering notary training for those interested.  This training is optional. For more information, go to training.gsccca.org.

Special Instructions for Renewal by Mail

  • Please remember, we cannot process a renewal application any sooner than 30 days prior to expiration, nor can we process the application if the commission has already expired.  Any renewal packets received in this office after the expiration date will be rejected.
  • When completing the application packet online with the GSCCCA, please follow all instructions  carefully.  Failure to do so could cause your application to be rejected.
  • Payment information will be entered during the application process at the GSCCCA website.  GSCCCA will not charge your credit card until your application is processed and accepted in this Clerk's Office.  In the event of a Card Error message during processing, we must reject the application packet back to you in the mail without processing.  You would then need to complete another application.
  • A Renewal Application By Mail that includes a name change cannot be processed unless proof of the name change is provided.

To obtain copies of plats or documents through the mail, a written request must be submitted along with book and page information and copy fee.

Plat Electronic Recording Rules

The amendments to Title 15 and 44 of the Official Code of Georgia Annotated, known as HB 1004 of the 2016 legislative session, relating to courts and property, provide for the filing of electronic images of maps, plats and plans. Effective January 1, 2017, maps, plats and plans are required to be electronically filed with the Superior Court Clerk's office.

Trade Names

Georgia law requires that every person, firm or partnership carrying on in this state any trade or business under any trade name or partnership name which does not disclose the individual ownership of the trade, business or profession shall before commencing to do business, file a registration statement in the office of the Clerk of Superior Court and that notice of such filing shall be published in the legal organ of the county once a week for two weeks.

In an effort to provide ease and convenience, Henry County Superior Court Clerk's office, in conjunction with the Georgia Superior Court Clerks' Cooperative Authority, has developed an online electronic filing portal.
